Terms of Use

Please read carefully. These Terms of Use (“Terms”) form a legally binding agreement between you (“you” or “User”) and INTEREX GROUP, a company registered at Ul. Michała Kleofasa Ogińskiego 11/9, 03-318 Warszawa, Poland (“we”, “our”, “us”). By clicking “Agree” and using a bank card (credit or debit) to buy digital assets through our app, you acknowledge that you have read, understood, and accepted all of the provisions below. If you do not agree, do not use this Service.

1 Definitions

  • Digital Asset / Digital Payment Token (DPT). A cryptographically secured, transferable token recorded on a distributed ledger (e.g., Bitcoin, Ether).
  • Bank-Card Purchase Service. A feature that allows Users to pay fiat currency with a debit or credit card and receive Digital Assets, facilitated by third-party payment processors or banks.
  • Commercial Agent Authority. Your limited, revocable mandate appointing INTEREX GROUP as your commercial agent solely to (i) receive fiat funds via card payment, (ii) acquire Digital Assets on your behalf, and (iii) deliver such assets or fiat in settlement of an order.

2 Acceptance; Amendments

  • Your click on “Agree” constitutes acceptance.
  • We may amend this Agreement at any time. Updated terms take effect upon in‑app notice. Your continued use constitutes acceptance of the amendments.

3 Eligibility & Compliance

  • You represent and warrant that you:
    • are at least 18 years old and possess full legal capacity;
    • use the Service only for yourself and not on behalf of any third party;
    • will comply with all laws and regulations applicable to you, including sanctions, AML and CTF rules;
    • are not located in, or a citizen/resident of, any jurisdiction in which Digital‑Asset trading is prohibited or restricted (e.g., jurisdictions listed by the Library of Congress as subject to an absolute or implicit ban);
    • ensure that all fiat and/or Digital Assets used are legally sourced and belong to you.
  • Successful completion of our KYC / CDD programme is required before any order execution. We may request additional information at any time.

4 Account Security

  • Keep your credentials and payment data confidential.
  • You bear all responsibility for losses arising from unauthorised access resulting from your negligence.
  • Notify INTEREX GROUP immediately of any breach or suspicious activity.

5 Commercial‑Agent Service Flow

  • Appointment. By placing an order you irrevocably appoint INTEREX GROUP as your limited payment collection agent for the sole purpose of facilitating settlement and executing the purchase or sale of Digital Assets in accordance with your instructions.
  • Order Steps. (i) You submit a buy or sell order. (ii) Our processor charges your card / receives your coins. (iii) Upon receipt of cleared funds or coins, we acquire or dispose of Digital Assets as agent. (iv) We deliver Digital Assets to your nominated wallet or fiat to your nominated bank account.
  • Each order is a one‑off transaction; no recurring authority is granted.

6 Risk Disclosure (Non‑Exhaustive)

1. Price Volatility. Digital‑Asset prices are highly volatile; values may increase or decrease rapidly, and you could lose all funds invested. 2. Regulatory Risk. Legal status varies globally; some countries ban or restrict crypto trading. Regulatory changes may affect your ability to use or trade Digital Assets. 3. Technology & Operational Risk. Blockchain congestion, protocol bugs, Internet or hardware failure may delay or prevent transactions. 4. No Deposit Insurance. Digital Assets are not bank deposits and are not insured by any government scheme. 5. MAS‑Mandated Warning (for Singapore users). Before paying any money or DPT you should be aware: (i) You may not recover your money or DPTs if our business fails; (ii) Transact only if familiar with the DPT; (iii) Buy DPTs only if prepared to lose all funds; (iv) Stablecoins are not risk‑free. 6. This list is non‑exhaustive. Assess your financial situation and consult an independent adviser before trading.

7 Wallet‑Address Ownership & Irreversibility

  • You must supply a self‑controlled wallet address; blockchain transfers are irreversible.
  • Transfers to exchange‑hosted wallets are governed by that exchange’s terms; INTEREX GROUP is not liable for any delays, rejections or losses at the third‑party exchange.
  • If you provide an incorrect, incompatible or incomplete address/tag, you bear the full loss.

8 User Input Accuracy & No Liability for Errors

      You are solely responsible for verifying all wallet addresses, bank details and order information before submission. INTEREX GROUP will not be liable for execution based on erroneous or incomplete data supplied by you.

9 Payment Methods & Cash‑Advance Warning

  • Accepted methods include debit/credit cards and bank transfers in your own name matching your KYC profile.
  • Credit‑Card Cash Advance. Your issuer may treat a crypto purchase as a cash advance, incurring immediate interest or additional fees. Consider using a debit card or bank transfer to avoid such costs.
  • You shall not initiate chargebacks or payment reversals once an order is executed.
  • Payment‑method availability depends on your jurisdiction and third‑party processor constraints.

10 Pricing, Fees & Difference Adjustments

  • The displayed price is indicative. The Final Price is locked immediately before execution.
  • Network, processor, FX or platform fees apply as shown in the order summary.
  • Under‑payment. If net funds received are less than required, INTEREX GROUP may (i) automatically execute based on the net amount or (ii) request instructions; failure to respond may lead to cancellation.

11 Execution & Irrevocability

  • An order remains pending until execution.
  • Upon execution (including receipt of valid proof‑of‑payment for bank transfers) the order is final, binding and non‑refundable, save for unauthorised or incorrect transactions caused solely by INTEREX GROUP (see Refund Rights).
  • INTEREX GROUP reserves the right to decline or cancel any order at its sole discretion.

12 Delivery

  • Purchases: Digital Assets will be dispatched to your nominated wallet as soon as reasonably practicable. Blockchain confirmation times may vary.
  • Sales: Fiat funds will be remitted to your nominated bank account after receipt and clearing of your Digital Assets.
  • You will receive an electronic trade confirmation (tax invoice) for each executed order.

13 Refunds, Failed Payments & Refund Rights

  • No Refunds on executed crypto transactions due to their irreversible nature.
  • If a payment method is declined, INTEREX GROUP may cancel, partially fulfil, or debit an alternative method authorised by you. Applicable fees on failed attempts attributable to you will be deducted from settlement amounts.
  • You may request a refund for unauthorised or incorrect transactions caused by INTEREX GROUP, provided you notify us within 72 hours of occurrence.

14 Suspension & Termination

      We may suspend or terminate the Service without prior notice for reasons including (i) compliance with law or regulator demand; (ii) protecting our reputation; (iii) suspected breach, fraud, AML/CTF concerns; (iv) third‑party processor denial; (v) force‑majeure events; or (vi) your failure to provide requested information. Pending orders may be cancelled and assets withheld where legally permitted.

15 Force Majeure

      We are not liable for any delay, failure in performance, or interruption of the Service that results directly or indirectly from events beyond our reasonable control, including but not limited to acts of God, civil or military authority, war, terrorism, civil disturbance, labour dispute, fire, flood, severe weather, pandemic, power failure, equipment or software malfunction, interruption in telecommunications or Internet services, or blockchain protocol failures (including forks or network congestion).

16 Governing Law & Dispute Resolution

      This Agreement is governed by and shall be construed in accordance with the laws of the jurisdiction in which the Contracting Entity is incorporated, without regard to conflict‑of‑law rules. Any dispute, controversy or claim arising out of or in connection with the Agreement shall be submitted to the exclusive jurisdiction of the competent courts of that jurisdiction. Before commencing court proceedings, the parties shall attempt in good faith to resolve the dispute through amicable negotiations.

17 Miscellaneous

  • Survival. Provisions which by their nature survive termination (including but not limited to liability, indemnity, intellectual‑property, tax, and dispute‑resolution clauses) shall remain in force.
  • Severability. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • Change of Control. In the event of a merger, acquisition or other corporate reorganisation, we may transfer or assign your data and our rights and obligations under this Agreement.
  • Assignment. INTEREX GROUP may assign this Agreement or any rights or obligations hereunder. You may not assign or transfer any of your rights or obligations without prior written consent.
  • Language. Only the English version of this Agreement is authoritative; any translation is provided for convenience only.
  • Electronic Communications. You consent to receive notices and communications electronically via the Site, e‑mail, SMS, or in‑app notifications.
